In California, family code section 3040 provides that child custody should be granted according to the

arrangement so long as both are considered fit by the courts and joint custody is in the child's best
interest.

intervene.  It is important to consider that a judge is not making a determination of what is "fair" to the
parents, but of what is "best" for the children.  It is always best to be able to come to an agreement
with your spouse about child custody outside of court.  Should you find yourself in a situation where
the two of you cannot agree on the terms of custody either in our outside of mediation,  it is
